Andrea Peraner-Sweet obtained a lack of probable cause finding before the MCAD on behalf of our client, a nonprofit community-based health care provider on claims of racial discrimination and retaliation brought against it.


Andrea Peraner-Sweet won an appeal affirming the Superior Court’s entry of summary judgment in favor of our client, Massachusetts General Hospital. The Appeals Court affirmed the Superior Court’s finding that Massachusetts General Hospital did not engage in discriminatory conduct when it terminated its employee for poor performance.


Robert Mendillo obtained a favorable money settlement in a client’s case against a former employer. After the former employer had sued our client for theft of trade secrets, we brought a counterclaim for Wage Act violations on his behalf. The six-figure settlement included all of the client’s unpaid commissions, attorneys’ fees and costs, and dismissal with prejudice of the former employer’s case.


Andrea Peraner-Sweet obtained dismissal of two different employment discrimination cases filed against our client Massachusetts General Hospital. The Superior Court awarded MGH summary judgment in the case of Zhu v. Massachusetts General Hospital, and the United States District Court for the District of Massachusetts allowed MGH’s motion to dismiss plaintiff’s claims in McBride v. MCAD et al.


Robert Mendillo obtained award of summary judgment on behalf of our client, whose sales commissions were unlawfully withheld in violation of the Massachusetts Wage Act. The client recovered all withheld commissions, attorneys’ fees and costs.


Andrea Peraner-Sweet obtained a lack of probable cause finding from the Massachusetts Commission Against Discrimination when it found that our client had not engaged in discriminatory conduct in a place of public accommodation.


Jonathan W. Fitch, representing a large corporate employer, obtained a preliminary injunction enforcing a non-compete and confidentiality agreement against a former executive of a company recently acquired by the client.


First Circuit Court of Appeals affirmed summary judgment obtained by Jonathan W. Fitch for employer and rejected employee’s claims for wrongful termination based on sex, national origin and disability discrimination.
