Resolving Construction Disputes Involving Subcontractors

From law offices in Boston, Massachusetts, Fitch Law Partners LLP represents homeowners, general contractors, developers and subcontractors in a wide variety of subcontractor disputes. We have handled numerous commercial construction cases involving claims against subcontractors for deficient work. We also help clients involved in payment disputes, delay claims, mechanic’s liens, and other complicated subcontractor issues.

Our lawyers have extensive experience advocating for clients in court, as well as in alternative dispute resolution forums, such as construction arbitration and mediation. We understand the unique challenges involved in construction litigation and have the construction industry know-how required to achieve results.

Examples of Our Subcontractor Dispute Practice:

  • Our law firm represented the interests of an electrical subcontractor on a substantial research laboratory construction project and in a payment dispute with several upstream contractors.
  • We represented a subcontractor steel erector in a delay claim brought by the owner in a case involving the construction of a university gymnasium.
  • We represent a national financial institution that leases office space in downtown Boston. A subcontractor responsible for installing carpet in the leased space has brought suit against the financial institution and the contractor who provided the carpeting. The subcontractor seeks payment from the carpeting contractor for alleged “change orders.” The subcontractor also seeks to establish a mechanic’s lien on our client’s leasehold interest in the property. We argue, among other things, that the work performed by the subcontractor cannot give rise to an enforceable mechanic’s lien.
